Metro-North Engineer Who Fell Asleep In Fatal Crash Gets Lifetime Pension

A Metro-North engineer who derailed a 2013 train after falling asleep in the Bronx near the Spuyten Duyvil station will receive a lifetime disability pension, according to lohud.com.

William Rockefeller will receive $3,200 a month in addition to a federal railroad retirement pension he was awarded, according to lohud.com.

The decision comes weeks after Rockefeller filed a $10 million lawsuit Dec. 1 in U.S. District Court in New York saying Metro-North is at fault for the derailment and should have equipped the train with an automatic braking system, according to lohud earlier this month.

The assistant conductor was awarded at least $835,000 for her injuries in 2015, the Daily Voice reported.

The Sunday morning train from Poughkeepsie was going 82 mph when it derailed Dec. 1, 2013 on its way to Manhattan, killing four, injuring 61 and paralyzing Metro-North mechanic Sammy Rivera of Ossining, traveling with his son, according to multiple media reports.

Rivera lost his $85,000-a-year salary in April and lives in a Cortlandt Manor Nursing home, his $100 million lawsuit in limbo, according to lohud.com. 

He lost his salary weeks after Metro-North countered his lawsuit saying they were not responsible for his injuries because he was on a free employee train pass, according to lohud.com.
