Stamford Driver Ticketed For Using Cellphone In Death of Elderly Bicyclist

STAMFORD, Conn. -- The driver who struck and killed an elderly bicyclist in May has been given a ticket for using his cellphone when the accident occurred, Stamford Police announced Thursday.

Abdul Aziz, 72, of Stephen Street, Stamford, was struck at 9:39 a.m. May 9 by a Toyota Sienna minivan as he was attempting to cross Tresser Boulevard, police said. He died the following day.

Jerry Bastien, 28, of Rock Spring Road Stamford, was driving the minivan, police said. 

Bastien was given a ticket for use of hand-held mobile telephones and mobile electronic devices by a motor vehicle operator. His lawyer was served the summons Thursday, police said.

The minivan was traveling east on Tresser just past Edith Sherman Drive when it struck the bicyclist, police said.

Aziz was attempting to cross Tresser from south to north, police said. The bicycle struck the passenger side of the Toyota, and which Aziz was knocked to the pavement and suffered a severe head injury, police said. 

The investigation determined through witness statements, surveillance video, and court orders that Bastien was on his cellphone at the time of the collision, police said.

Bastien is scheduled to appear in Stamford Superior Court on Aug. 31.

This case was investigated by Officers Ryan McAllister and Hugh Mullin of the department's Collision Analysis and Reconstruction Squad.

If convicted, the fine is $150 for a first violation, according to the Connecticut General Statutes.
